As per the DRE boys, the DOT and State police are stopping racers on Topeka Ave by the track preforming the Q & A and checks..... lisense, decals, fuel, sounds like the full meal deal....

A few years ago there were some people showing horses, no money just trophys IRS ruled the Trohys had a $ value therefore they showing for $$$$$. Just look up the ruling

As long as you report any winnings to the irs, but do not deduct the expences it is ok. As soon as you start deducting the expences it becomes a business.

If you have living quarters trailer it has the same search/seizure protection as your home. Tell them to get a warrant.

I think a motor home/car home falls under the Fourth Amendment exception rule in most cases. You have your federal law and your state laws that intercede with each other. Most laws stipulate "furthermore the vehicle is licensed to operate "on public streets, was or can be serviced in public places and was and is subject to extensive regulation and inspection". I have an uncle that is sheriff in a Tenn county and I asked him about being stopped and or search and seizure. He assured me that if I come thru his county, he could stop me and search me without a warrant and he added (one way or the other). So I took his word for it and I smoked all my marwanna before I drove that way they cant find nun when they search

OK --so has anone talked to any rigs "that were stopped"??? What were they asking ,looking for , or examining etc licence, plates, registration, DOT logbooks,portable scales ??? Was this a roadblock or just random vehicles they were stopping???? Inquiring minds want to know. Thanx Comp

You can refuse to give consent to a search. If you do, the officer has a couple of choices. He can get a warrant, or he can do the search on the basis of probable cause. Or, he might even let you go. A search without consent and without a warrant can be problematic for them, as if no probable cause can be shown, nothing they find is admissible in court, meaning there is no evidence.

Just be aware that creating an adversarial environment with law enforcement is a lot like doing the same thing with a tech official. They probably can find something if they want to and they look. When they do, the consequences are likely to be a lot worse.

As the man says, you pays your money and you takes your chances. You will want to retain a lawyer, and you will hope you can afford one who is better in court than they are.

We were stopped in central Iowa by carrier enforcement. License, insurance, registration etc....then in the cruiser for questions: whose the major sponsor, any decals, any lettering on car, where are we going, are we competing for money, what kind of race, etc etc....finally sent off with a "be safe"....about twenty minutes on the side of I-80.

while I was questioned in the cruiser, my partner got similar questions in the tow vehicle....I guess to see how they matched up.....wanted to smart off, but went along politely

Ok here is the story.Me and Pat were on Topeka Blv I was on the phone with customer and looked up and saw Police behind us .I pulled over on Ornsby Rd the first thing the officer ask me was where is your DOT # .I told them I did not have a clue what they were talking about. # 2 question was WHO IS YOUR SPONSOR, I replyed we did not have sponsors.# 3 question does your car have Decals on them.#4 question can we see the car ? I said yes and went and opened trailer side door,they looked in ans saw Contingency decals and said OH these are your Sponsors.I replyed NO they give us some kind of prize .#5 Do you haul your race fuel ? I replied no just 5 gal for generator #6 can we see Registation for Camper and Trailer .I went in motorhome to get it and Female Officer followed me inside and ask #7 Does your Sponsor pay for all this nice stuff? My reply was NO this is on my Dime. My motorhome and trailer are registered Private About that time a State Police officer showed up and ask Pat if these to girls were giving us a Hard time Pat replied to him and said they are about to make your weekend really busy. At that point The State police man gave me my paperwork back and said Have A Good Race And Mickey is 2 1/2 gallon too much

Racers beware, ignorance of the law is no excuse just a good way to fill their state and city coffers with your hard earned dollars. In my town our treasurer reported that the surplus of 5.9 millions was due mostly from new fines that hadn't been previously been given. You would think that NHRA would work with the DOT and State government to help the racers, considering the influx of money in their area. Maybe this is something Divisional Directors should look into. Maybe making sure that the State Police Commandant is the next Race Marshall for the upcoming event,lol CR

actually I got a hold of Track Manager and they got the DOT stopped So thanks to Topeka track looking out for us racers

Oh Mickey you would like these officers and you know we ran out on day 3

What gets me is the revenue that racers attending a National or Divisional brings to the local area, and that is how someone with a different state or county license plate is treated? I don't get it? Glad to here the track got involved.

It seems to me that at any National race the Track MGR and a Rep. from NHRA would have the sense to get together with the traffic(law) enforcement groups and go over things like this to not only prevent opportunistic law enforcement people from basically HARRASING arriving racers or going on witch hunts to enforce traffic laws---sorta co -ordinate what rules will be strictly enforced and to keep things moving along smoothly

This is a great idea, but I can't see law enforcement thinking past what they will get out of this. As far as NHRA ........well
In the long run their just hurting future business, hand out a bunch of high dollar tickets and next year that many people won't show up.

The 2 officers that stopped us were DOT .The State Trooper came up later .The kicker to this is they kept asking about Sponsors.In my opinion someone has given them a little info and if you answered the question wrong you got the prize.Also my Coach and Trailer is titled private.That is what saved me for sure.

Off topic, but I saw a several guys with DRE tee shirts on at Norwalk and I
didn't get one with my diaper........lol
Would like one, let me know where, when and how much.
