There's a very scary video floating around on YouTube with footage of the Pro Mods getting sideways trying to stop in the very short shut off area. They didn't fix things properly according to the ADRL, who refused to race there. Thus the lawsuit which I would bet has been thrown out by now. I would think the track is obligated to provide a safe venue (or at least meet previous stipulations) but I'm not a lawyer.
Just another data point as to the track's operation.
