What if I disagree with a VA decision
If your VA claim is denied, you have one (1) year to respond.Here are those forms to make your response:
VA Form- 20-0995- Supplemental Claim Use this form to request a SUPPLEMENTAL CLAIM of the decision you received that you disagree with. A SUPPLEMENTAL CLAIM is a new review of an issue(s) previously decided by the Department of Veterans Affairs (VA) based on submission of new and relevant evidence. VA Form 20-0966b Level Review Higher In choosing this option, you are asking for another review of the same evidence. A senior reviewer will take a new look at your case and determine whether the decision can be changed based on a difference of opinion or an error. Approximately 70% or more of first time claims are rejected---- many for lack of information etc--- check over your claim forms carefully before you submit them make sure you answer ALL of the required questions that pertain to what you are claiming and have all of the evidence you need so your claim is not rejected or is sent back for additional info--- BE PATIENT these things take time some up to 6 moths or more for a decision---if denied reapply immediately don't wait time is of the essence here---FED 387
